Wrongful Death can result from any
type of accident or malpractice. Once someone dies
however, there are many additional considerations. Who will
handle the Estate? Who can bring a lawsuit? Who will collect
the money?
How someone dies, whether or not they were
conscious or unconscious, suffered physical pain, or mental
anguish, are important consideration for determining the value
of your case. Other considerations include, loss of support
for a spouse and child, loss of services to a spouse, loss of
parental guidance, and whether or not an immediate family
member was in the "zone of danger" when the decedent
died.
Often it is difficult to broach the subject of a
lawyer just after a loved one has died, but the sooner you
contact us the better our chance of preserving and protecting
the rights of the surviving family members.
If
possible, obtain pictures, police reports, witness information
,death certificates, marriage certificates of spouses , birth
certificates of childrens, a list of medical providers and
dates the decedent was treated
Do
not speak to anyone. Insurance companies and their
investigators are especially anxious to speak to you after an
accident. They tape your conversations, with or without your
permission in an attempt to limit their liability and exposure
right from the start before you have a lawyer.
Do not
complete any paperwork. Send all correspondence to your
lawyers, and refer all callers to them - That's their
job.
