Product Liability refers to
liability of a manufacturer, wholesaler or retailer of a
product which was improperly designed or defectively
manufactured thereby resulting in a product which was
unreasonably dangerous for its intended use.
Most
products are subject to the law of Product Liability including
food, drugs, appliances, medical devices, and vehicles.
Preservation of the actual item
which cause injury is critical. These are
complex cases which require extensive review by our product
experts and engineers. Contacting us early on will help to
preserve and protect your rights, but, you will further your
case by preserving "THE EVIDENCE" to the extent possible
before you meet with us. While it is often possible to obtain
samples, or exemplars of the product which caused injury, if
the appliance, clothing, device, or other product upon which
your claim is based is perserved, it is easier to determine
the cause of the defect, establish liability, and obtain a
damage award to compensate you for your injury.
Do not speak to anyone. Insurance
companies and their investigators are especially anxious to
speak to you after an accident. They tape your conversations,
with or without your permission in an attempt to limit their
liability and exposure right from the start before you have a
lawyer.
Do not complete any
paperwork. Send all correspondence to your lawyers,
and refer all callers to them - That's their job . The lawyer,
will investigate the accident, obtain police reports and other
records pertaining to the accident, research the law, file for
your medical benefits and lost wages, establish claims with
defendant insurance companies, and when appropriate, commence
a law
suit.
